Proposal for an Order regulating the first auction mechanism for the granting of the economic regime for renewable energies and establishing the indicative timetable for the period 2020-2025
The purpose of this order is to regulate the first auction mechanism for the granting of the economic regime for renewable energies, established in Royal Decree 960/2020, of 3 November, which regulates the economic regime for renewable energies for electricity production facilities.
To this end, this order establishes the particularities and adaptations necessary in the general methodology for the selection of bids in the competitive tendering procedures called, with the aim of adapting it to the characteristics of the calls. It establishes the processes that make up the auction mechanism, including the matching mechanism to be used to take into account the existence of minimum reserves of the product to be awarded, as well as the restrictions relating to guaranteeing competition in the auction and the characteristics that must be satisfied by the bids submitted by the agents participating in the competitive tendering procedure.
Furthermore, it regulates the formalities and procedures associated with the electronic register of the economic regime for renewable energy regarding the maximum period for the presentation of the application for registration in the pre-allocation state and the amount of the relevant economic guarantee, as well as the documentation to be provided necessary for registration in this register in both states, pre-allocation and operation.
It also establishes the mechanism for monitoring the viability and maturity of the projects through which the allocated power is materialised by means of the competitive tendering mechanism based on a procedure for identifying the installation and accrediting the obtaining of the administrative construction authorisation or equivalent document.
It implements the penalties provided for in Article 20 of the Royal Decree regulating the economic regime for renewable energies, in order to provide incentives for compliance with the obligations relating to the minimum auction energy acquired by the installations receiving the economic regime for renewable energies.
It establishes a timetable for the auctions under the economic regime for renewable energies over the period 2020-2025, including indicative deadlines, the frequency of calls for tenders, the expected capacity and the technologies envisaged.
On 6 November 2020, the Ministry of Ecological Transition and Demographic Challenge published its proposed order regulating the first auction mechanism for granting the economic regime for renewable energies and establishing the planned timetable for access to economic support instruments, together with its report on regulatory impact analysis, for the purposes set out in article 26.6 of Government Act 50/1997, of 27 December.
The adoption of this order is the result of the mandate which, due to the extraordinary and urgent need, has been established in the fourth additional provision of Royal Decree Law 23/2020, of 23 June. For the same reasons of urgency, by virtue of article 26.6 of Law 50/1997, of 27 December, of the Government, the period of the hearing procedure is reduced to 7 days from the day following that of publication on the website.
This same text has been sent to the National Commission for Markets and Competition for a report and for the hearing procedure to be carried out by this body through the Electricity Advisory Council.
